Terms of Service

Welcome to BarChata. By accessing or using our platform — including BarChata Social, BarChata Biz, BarChata Marketplace, and BarChata Partners — you agree to these Terms of Service. If you do not agree, do not use our services.

1. Eligibility

You must be at least 18 years old, or the legal drinking age in your jurisdiction (whichever is greater), to use BarChata. By creating an account, you represent that you meet this requirement.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current information during registration and to update it as needed. BarChata reserves the right to suspend or terminate accounts that violate these terms.

3. Acceptable Use

You agree not to: post content that is illegal, defamatory, abusive, or infringes on the rights of others; impersonate any person or entity; use automated tools to scrape, crawl, or harvest data; attempt to gain unauthorized access to our systems; or use the platform for spam, phishing, or any fraudulent activity.

4. Hearts & Loyalty Program

Hearts are a loyalty mechanism within the BarChata ecosystem. They are not currency, securities, or property. Hearts have no cash value and cannot be exchanged for cash outside the platform. BarChata reserves the right to modify the Hearts program, including earning rates and redemption terms, at any time with reasonable notice.

5. Venue Partners

Businesses using BarChata Biz agree to the BarChata Merchant Agreement, which governs the use of our business tools, loyalty integration, and advertising features. Venue partners are responsible for ensuring their listings are accurate and their use of customer data complies with applicable laws.

6. Content & Intellectual Property

You retain ownership of content you post on BarChata. By posting, you grant BarChata a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the platform. BarChata’s name, logo, and product names are trademarks of BarChata Corp and may not be used without written permission.

7. Payments & Billing

Paid plans are billed monthly or annually as selected. All fees are non-refundable except where required by law. BarChata uses Stripe to process payments securely. You authorize us to charge your payment method for recurring subscription fees until you cancel.

8. Termination

You may delete your account at any time. BarChata may suspend or terminate your account for violations of these terms, with or without notice. Upon termination, your right to use the platform ceases immediately. Accrued Hearts may be forfeited upon account termination for cause.

9. Disclaimers

BarChata is provided “as is” and “as available.” We make no warranties, express or implied, regarding the platform’s availability, accuracy, or fitness for a particular purpose. We are not liable for the actions of venue partners, advertisers, or other users.

10. Limitation of Liability

To the maximum extent permitted by law, BarChata Corp shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of data, revenue, or business opportunities.

11. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.

12. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated through our apps or by email. Continued use of the platform after changes constitutes acceptance.
